These Terms and Conditions (“Terms”) set out the basis on which Express Pathology provides pathology collection and related services to clients (“you”, “your”). By booking, purchasing, or using our services, you agree to these Terms.


1. Service Overview

1.1 Express Pathology provides blood collection and sample delivery services for individuals who require pathology testing.
1.2 All samples are processed by third-party accredited laboratories, including 4Cyte Pathology and associated providers.
1.3 Results are sent directly to the requesting medical practitioner, or where applicable, to the client in accordance with law and laboratory procedures.
1.4 Express Pathology does not interpret results or provide medical advice. Any medical queries regarding results must be discussed with your qualified healthcare professional.


2. Eligibility

2.1 You must be at least 18 years old to use our services.
2.2 Minors may be tested only with the consent of a parent or legal guardian and where a valid pathology referral is provided.
2.3 You are responsible for ensuring all information supplied (including personal details and any pathology request forms) is accurate and up to date.


3. Booking and Payment

3.1 Services are available by appointment only, either via our website or through direct communication with our team.
3.2 Payment is required at the time of booking unless otherwise agreed.
3.3 Prices displayed are in Australian dollars (AUD) and inclusive of GST where applicable.
3.4 We reserve the right to update fees at any time. Prices confirmed at the time of your booking remain valid for that booking.


4. Discounts and Promotional Offers

4.1 From time to time, Express Pathology may offer promotional discounts or referral incentives.
4.2 Discounts apply only to Express Pathology’s service fees (e.g., nurse collection, administrative costs) and do not reduce or alter laboratory charges, government fees, or any medical interpretation services.
4.3 All promotions will have a stated validity period and may include restrictions such as geographic availability or applicable test panels.
4.4 Discounts cannot be exchanged for cash, used in conjunction with other offers (unless specified), or applied retroactively to past purchases.
4.5 We reserve the right to modify or withdraw promotions at any time without notice.
4.6 All promotional material complies with the Australian Health Practitioner Regulation Agency (AHPRA) advertising guidelines, meaning:

  • No discounts are presented in a way that implies urgency or pressure to obtain medical services.

  • Offers are described factually, with clear terms, and without making claims about health outcomes.


5. Cancellations and Refunds

5.1 If you need to reschedule, you must provide at least 24 hours’ notice.
5.2 Refunds are considered on a case-by-case basis. Fees may be withheld for administrative and nurse scheduling costs already incurred.
5.3 Once a sample has been collected and submitted to the laboratory, no refund can be provided.
5.4 In the event that Express Pathology cancels a booking due to unforeseen circumstances, a full refund or rescheduled appointment will be offered.


6. Results and Medical Disclaimer

6.1 Express Pathology facilitates sample collection only and does not interpret, advise on, or provide diagnoses based on results.
6.2 Results are sent securely to the referring doctor (if provided) or released to you in line with laboratory processes.
6.3 All medical interpretation, advice, and treatment decisions must be sought from your qualified healthcare professional.
6.4 Nothing in these Terms creates a doctor–patient relationship between you and Express Pathology.


7. Privacy and Confidentiality

7.1 We are committed to complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
7.2 Personal information, including health information, is collected only for the purpose of delivering our services.
7.3 We take all reasonable steps to protect your data against misuse, loss, or unauthorised access.
7.4 You have the right to request access to your personal information held by us and to request corrections.


8. Liability and Limitations

8.1 While we make every effort to provide accurate, timely, and professional service, Express Pathology is not responsible for:

  • Laboratory errors or delays outside our control.

  • Consequences of medical decisions made without consultation with a qualified practitioner.

  • Circumstances beyond our reasonable control (e.g., courier delays, technical outages).
    8.2 To the extent permitted by law, our liability for any claim is limited to the amount you paid for the service in question.


9. Governing Law

9.1 These Terms are governed by the laws of the Commonwealth of Australia and the state in which the service was delivered.
9.2 Any disputes shall be resolved in the courts of that state or territory.


10. Updates to Terms

10.1 We may amend these Terms at any time by posting the updated version on our website.
10.2 Continued use of our services after such amendments constitutes acceptance of the revised Terms.
